We may monitor the Services and disclose information obtained through such monitoring to comply with any law, regulation, or governmental request, to manage and operate the Service, or to protect our interests and those of our other customers. 2.1 We provide reselling of prepaid data plans through data-only eSIMs (it does not offer voice and SMS) and customer support as set out in these Terms (Services). You register and buy the eSIM through our webapp and/or mobile app.
2.2 We shall use reasonable efforts to provide you with the Services. We do not guarantee that the Services will be uninterrupted, or error free.
2.3 We use third parties to provide the connectivity relating to the Services and we are providing the resale of the Services.
2.4 We reserve the right to amend the specification of the Services if required by any applicable statutory or regulatory requirement.
2.5 We will ensure the maintenance of confidentiality of any information provided by you to us under or in connection with these Terms. We will ensure appropriate measures are in place to prevent any unauthorized accessing, reviewing and disposing of such information and we shall not disclose your confidential information without your prior written consent, except as set out in these Terms or our privacy policy, or where we are required to do so by applicable laws.

3.1 The eSIM data packages from us are offered as-is, and no further modifications or customization can be made based on individual requests once purchased.
4.1 Our Service allows you to access services provided by third-party publishers, which are provided under their responsibility and terms.
4.2 In using the Services provided by us, you must not engage in any action that is abusive, illegal or fraudulent, contrary to customary norms or offensive. You undertake that you will not decompile, reverse engineer or introduce any virus, worm, trojan horse or any malware as part of accessing or using the Services.
4.3 In using the Services you acknowledge and agree that you are more than 18 years old and you are legally able to accept these Terms.
4.4 Use of the Services are personal and cannot be shared between two persons.
4.5 We may suspend or terminate your use of the Services if you breach these Terms. During any period of suspension, you shall continue to pay all Fees due in respect of the suspended Services.
4.6 While you can remove and add the eSIM at any time from / on your device, it must remain on a device for the Service to function until the Data plan is fully used or has expired”
4.7 It is your responsibility to remove the eSIM from your device before adding it to another device. The eSIM may not be installed on more than one devices simultaneously.
5.1 Device compatibility may depend on the carrier and country of origin. Before purchasing the Service, You must ensure that the device you are going to use our Service on is eSIM-compatible. You are responsible for ensuring that your device is compatible with the Services and the network is unlocked.
5.2 By checking the box that confirms that the Customer's device is eSIM compatible, the Customer is then held responsible for the accuracy of the information they provide.
6.1 Upon completing the order via our webapp or the mobile application you acknowledge and agree to be bound by these Terms.
6.2 Right of withdrawal: You have a period of fifteen (15) calendar days from the purchase date to apply for refund of those data plans / eSIMs that you have not started using. You can do this by accessing the relevant order on the app and request a fund for the same. You understand that by accepting these Terms and starting to use the Services, you expressly agree to benefit from the Services and expressly waive the right to exercise the right of withdrawal.
6.3 The activation of the eSIM is the Customer's responsibility.
6.4 The data packages will expire when the validity period expires or upon the Customer consuming the amount of the data provided in the package.
7.1 Price of the Services are indicated on the web and the app. The costs associated with the purchased Data plans are provided to you before completing your purchase. By completing the purchase, you agree to and accept these charges.
7.2 The currency for fees is the currency as set out at the time of the purchase. We will show VAT and any other fees separately where applicable.
7.3 Our payments are operated by Tap Payments by credit card, debit card, Google Pay, Apple Pay and any other payment methods as provided by Tap Payments and presented on our payment channels.
7.4 Subject to the legal warranties applicable in your country, the customer has the right to ask for a refund or data plan / eSIM replacement by contacting our customer care center if the eSIM cannot be installed and used due to a technical problem from us that cannot be solved within 30 days following the purchase of the Services. In order for any refund to be granted you need to cooperate with us so that we can resolve the issue promptly.
7.5 If the eSIM has not been installed or the data plan is not activated, you may request a full refund within fifteen (15) calendar days of purchase.
7.6 Each data package has its own data size and validity period. No refund of any form will be offered if the consumption started on a data package even if the data was not used completely.
7.7 No refunds or remuneration of any kind will be issued due to charges from:
(ii) alternate sim cards;
(iii) alternate providers;
(v) fraudulent purchases;
(vi) accidental purchases; or
other charges that are not directly linked to your eSIM account with us.
7.8 You shall notify us within twelve (12) days of receipt of the invoice, if you have any queries or concerns. You will need to provide us with details of why the invoice amount is incorrect and, if possible, how much you consider is due.
7.9 Once a refund is approved and issued, it can take up to thirty (30) business days to appear on a statement depending on the bank.
7.10 To report an issue with your refund request, contact our support team via web or the app.
7.11 You are not entitled to offset any of its claims against claims from us, except where your claims are undisputed or have been confirmed by final court judgment.

8.1 As Our Services rely on third party providers and third parties’ network, We are not responsible for detriments arising due to the proposed service not being constantly available. We provide no guarantee of constant availability of the network service.
8.2 Nothing in these Terms shall attempt to exclude liability that cannot be excluded under applicable law. To the maximum extent permitted by applicable law, in no event will we be liable for any consequential, exemplary special, or incidental damages, including any damages for lost data or lost profits arising from or relating to the Services. Our cumulative liability arising from or relating to the Services whether in contract or tort or otherwise shall not exceed the amount paid for the Services in the previous one-month period.
8.3 We shall not be liable in case of a force majeure event or in case of a breach of your obligations.

9.1 We maintain full ownership of all intellectual property rights associated with our Services, including any content related to our Services.
9.2 You are permitted to use our Services strictly for personal use and not for resale, distribution, or any commercial purposes.
10. Governing law and jurisdiction
10.1 These Terms are governed by the laws of the United Arab Emirates and the courts of the United Arab Emirates have exclusive jurisdiction to settle any dispute or claim (including any non-contractual dispute or claim) arising out of or in connection with these Terms.
10.2 These Terms do not limit or affect your statutory rights under applicable law in your country of residence.
